Two Marion County Grand Juries have indicted three men arising from the May 1, 2019, altercation and shooting in downtown Indianapolis involving two Judges from Clark County, Indiana. Brandon Kaiser, Alfredo Vazquez, and Judge Andrew Adams have been charged for their alleged roles in the incident.

Marion County Prosecutor Terry Curry said complex circumstances in the investigation extended the length of the investigation and ultimately resulted in a decision to present the matter to two independent Grand Juries for criminal charging determinations.

“We appreciate those in the public, media, and the involved parties for their patience in this matter. Progress in the investigation did not halt on May 10, but rather entered into a strictly confidential phase in order to present a fair and thorough investigation to two independent Marion County Grand Juries,” Marion County Prosecutor Terry Curry commented.

Upon review of the evidence, the Prosecutor’s Office had determined that all four individuals could potentially be considered suspects of a crime.  In May, the Marion County Prosecutor’s Office requested that a Special Grand Jury be empaneled to hear evidence in this matter. Prosecutor Curry said his office anticipated that the investigation would involve granting immunity for the parties to testify as witnesses. Those same individuals would also be treated as targets in the investigation. Case law sets out that if immunized witnesses are also targets in an investigation, the matters should be presented independently to separate grand juries.

As a consequence, two Marion County Grand Juries independently heard evidence in this matter. The evidence was presented to the Grand Jurors by two independent teams of deputy prosecutors. As set forth in Indiana Statute, the “grand jury shall be the exclusive judge of the facts with respect to any matter before it.”

A Marion County Grand Jury has indicted Brandon Kaiser on 14 counts:

  • 4 counts of Aggravated Battery, Level 3 Felony
  • 2 counts of Battery with a Deadly Weapon, Level 5 Felony
  • 2 counts of Battery Resulting in Moderate Bodily Injury, Level 6 Felony
  • 2 counts of Battery Resulting in Bodily Injury, Class A Misdemeanor
  • 2 counts of Battery, Class B Misdemeanor
  • Carrying A Handgun Without a License, Class A Misdemeanor
  • Disorderly Conduct, Class B Misdemeanor

The same Marion County Grand Jury has indicted Alfredo Vazquez on 7 counts:

  • 2 counts of Battery Resulting in Moderate Bodily Injury, Level 6 Felony
  • 2 counts of Battery Resulting in Bodily Injury, Class A Misdemeanor
  • 2 counts of Battery, Class B Misdemeanor
  • Disorderly Conduct, Class B Misdemeanor

A separate Marion County Grand Jury has indicted Judge Andrew Adams on seven counts:

  • 2 counts of Battery Resulting in Moderate Bodily Injury, Level 6 Felony
  • 2 counts of Battery Resulting in Bodily Injury, Class A Misdemeanor
  • 2 counts of Battery, Class B Misdemeanor
  • Disorderly Conduct, Class B Misdemeanor

The same Marion County Grand Jury declined to file charges against Judge Bradley Jacobs.

“With the filing of these indictments, we will now move forward with the criminal prosecution of the allegations in a Marion County trial court,” Prosecutor Curry added.

All evidence and testimony presented to the Grand Jury is confidential under Indiana statute. An indictment is a finding of probable cause and no other information will be released at this time.

The cases against Brandon Kaiser and Alfredo Vazquez have been assigned to Criminal Court 2. The case against Andrew Adams has been assigned to Criminal Court 18.
