A complaint has been filed with the Marion County Election Board against newly sworn-in Center Township Constable Kenneth Allen.

The complaint, filed last week by former City-County Councilor William “Duke” Oliver, alleges Allen did not live in Center Township when he originally filed for the position.

A caucus of precinct committee people selected Allen on November 8 to replace Denise Paul Hatch, the former constable who had to step down after pleading guilty to official misconduct, a felony.

Allen listed his address on campaign finance forms as 28 East 16th Street in Center Township. However, Oliver states in his complaint that Allen lives with his wife, Rebecca, in Washington Township.  State law requires at least a year of residency to qualify to run for Township constable.

Indy Politics spoke with Oliver, who says he not only filed the complaint but also went to the apartment complex to find out if Allen lived there and was told he did not.

According to court records, Allen was subjected to eviction proceedings regarding the 16th Street address in January of last year; however, the proceedings were dismissed in February of 2023.
