The late State Senator Jean Breaux’s name will still appear on some ballots in the upcoming Primary.
Breaux passed away on Wednesday, March 20 after a long illness.
Marion County has printed its absentee ballots because Saturday was the deadline to send Military and Overseas voters’ ballots. Under federal law, Marion County has to send those 45 days before the primary, which was Saturday. Therefore, according to state election officials, her name will stay on at least some of the absentee primary ballots.
Under the current state law, Senate President Pro Tem Rid Bray informed Secretary of State Diego Morales about her death, and Morales sent a letter to Indiana Democratic Party Chairman Mike Schmuhl. Then the Election Division will send a notice to Marion Co that Sen. Breaux, who was a candidate for nomination in the Democratic primary,
However, there will be time to amend the primary election day ballots and possibly some of the absentee voting, so her name may not appear on ballots or machines printed after receipt of notification; however, the county election board will determine this.
State law does not allow the County party to replace Breaux on the ballot this primary. However, the party can fill the vacancy for the general election.
The party can fill the vacancy for the general election; a caucus of precinct committeemen will gather to fill the vacancy.
Breaux was running unopposed.
