A lawsuit has been filed against Indiana Attorney General Theodore Rokita over a recent opinion that CBD is a controlled substance similar to heroin and cocaine.
In January Rokita issued a legal opinion that THC is a Schedule 1 drug and therefore is illegal.
State and federal law contradicts Rokita’s opinion, however some CDB shops across Indiana have been told to either stop selling the product or have had their products confiscated by local law enforcement.
The MidWest Hemp Council filed the suit in federal court. They are asking for an injunction and for the court to declare Rokita’s opinion is contrary to state and federal law.
Indy Politics spoke with Shadi Khory, the owner of Indy E-Cigs and Dodi Hemp Products. He also owns a CBD manufacturing facility on Indianapolis’ east side.
You can hear Khory in the Leon-Tailored Audio above.
It runs for about 18 minutes.
