The Indiana Attorney General’s Office is releasing a legal opinion saying that CBD oil is illegal in the state of Indiana and there is no right for consumers to use it.
The advisory opinion follows a recent controversy where excise police had confiscated CBD from an Indianapolis health store, arguing it was illegal since it was a marijuana derivative.
Hill’s office says CBD is only allowed under a narrow provision of state law, i.e. children with a particular strain of epilepsy, otherwise it is illegal under both state and federal law. And even then it is only an affirmative defense to possession.
