A Marion County Small Claims Court judge will rule by Monday whether to hold Center Township Constable Denise Paul Hatch in contempt of court for allegedly interfering with an eviction.
Hatch faces an indirect contempt of court charge for attempting to stop an eviction recently at 742 N. Grant Avenue.
IMPD was evicting the tenant; however, Hatch’s attorney told the court they had filed for a stay and nothing could be done until there was a ruling.
The attorney for the landlord had argued for the appointment of a special constable to serve the eviction notice on the Grant address and all of their properties going forward.
Hatch’s attorney Roberta Ross had argued the judge should have recused herself due to allegations of bias against Hatch.
Judge Brenda Roper is expected to rule on the contempt citation Monday.
