Indiana lawmakers are passing legislation regarding hemp for the first time in a few years.

The Senate Tax and Fiscal Policy Committee today passed, by a vote of  11-1, SB 293, a bill addressing hemp flour.

The bill, sponsored by committee chairman Travis Holdman, would do the following…

  • Put safeguards in place around low THC hemp flour – delta 8, such as restrictions.  A person must be at least 21 to purchase the flour.
  • Repeals the definition of”smokable hemp” and criminal penalties concerning smokable hemp.
  • It makes it clear to local health departments that low THC is not food for food safety laws.
  • It clarifies hemp farmers can export out of state.
  • And it makes it clear that hemp flour cannot be sold directly to consumers but must go through a licensed manufacturer.
The bill now heads to the full Senate for amendments and then a vote.
